While much attention has been paid, both theoretically and practically, to the time after the transition from a non-democratic state form to a democratic one has been made, there has been little research on the period before such a transition.
The monograph refers to this phenomenon as “pre-transitional justice”. It explores both the theoretical contours of the term as well as a series of practical case studies, historical and contemporary. Thus, this volume, published within the International Criminal Justice series, offers the broadest possible overview of the objectives, mechanisms, and processes of pre-transitional justice scenarios. It is therefore primarily aimed at an academic audience, in particular scholars of classical transitional justice, international criminal law, international humanitarian law, and human rights. Furthermore, it will also be of interest to practitioners in related disciplines, as it describes specific case studies and methodologies of many pre-transitional justice mechanisms.
Rebecca Ohnesorge studied law and holds a bachelor's degree in English and history as well as an LLM in human rights. After working as a research assistant at the Institute for Criminal Law, Criminal Procedure Law and International Criminal Law of Prof. Dr. Moritz Vormbaum, she is now completing her second state law examination and a master's degree in history. Her research interests lie primarily in the areas of international criminal law, transitional justice, international humanitarian law and legal history; areas she has also published in.
